These Terms & Conditions ("Terms") govern your access to and use of the GiganPay payment orchestration platform, website, merchant dashboard and related services (together, the "Services"). By creating an account or using the Services you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Definitions
"GiganPay", "we", "us" or "our" means the operator of the GiganPay platform. "Merchant" or "you" means the business or person that registers for and uses the Services. "Transaction" means any payment instruction submitted through the Services, whether by card, cryptocurrency or another supported method. "Provider" means a third-party acquirer, gateway or payment network to which GiganPay routes Transactions.
2. Eligibility and account registration
You must be legally capable of entering into binding contracts and operate a lawful business to use the Services. You agree to provide accurate, current and complete information during registration and to keep it updated. You are responsible for safeguarding your credentials, API keys and signing secrets, and for all activity that occurs under your account. 3. The services
GiganPay provides a payment orchestration layer that routes Transactions to Providers according to rules you configure (including cascading fallbacks and allow/restrict conditions), together with reporting, settlement and related tooling. GiganPay is not a bank and does not itself acquire, hold deposits or issue cards; execution of payments is performed by the relevant Providers.
4. Merchant obligations
- Use the Services only for lawful purposes and in compliance with all applicable laws, card-network rules and Provider requirements.
- Do not submit Transactions connected to prohibited activities, including money laundering, terrorist financing, sanctioned parties, or goods and services that are illegal in the buyer's or seller's jurisdiction.
- Maintain accurate customer disclosures, refund policies and receipts for goods and services you sell.
- Secure your integration, including protecting API credentials and validating our signed webhooks before acting on them.
5. Fees and settlement
Fees for the Services are agreed with you when your account is opened and may include transaction fees, fixed fees, refund, chargeback and rolling-reserve terms. Applicable fees are visible in your merchant dashboard. Settlement timing and currency depend on your configuration and the relevant Providers. We may set off amounts you owe us against amounts payable to you.
6. Chargebacks, refunds and reserves
You are responsible for chargebacks, refunds, reversal costs and associated fees arising from your Transactions. We may establish and adjust a rolling reserve to cover anticipated exposure, and may suspend settlement where we reasonably believe there is elevated risk, fraud or a breach of these Terms.
7. Prohibited use
You may not use the Services to: process payments for another business without our approval (aggregation); test stolen cards; evade card-network or Provider rules; interfere with or disrupt the Services; or attempt to access data belonging to other merchants. We may suspend or terminate accounts engaged in prohibited use immediately.
8. Intellectual property
The Services, including software, design, documentation and trademarks, are owned by GiganPay or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Services for your business while these Terms remain in force. No rights are granted except as expressly set out here.
9. Data protection
Each party will comply with applicable data-protection law. Our collection and use of personal data is described in the Privacy Policy, and our use of cookies in the Cookies Policy. You warrant that you have a lawful basis to share your customers' data with us for payment processing.
10. Availability and support
We aim to provide the Services continuously but do not guarantee uninterrupted availability. Planned maintenance and factors outside our control (including Provider outages) may affect the Services. Support is available at [email protected].
11. Liability
To the maximum extent permitted by law, GiganPay is not liable for indirect, incidental, special or consequential damages, loss of profits, revenue or data. Our aggregate liability arising out of or relating to the Services in any 12-month period is limited to the fees you paid to us for the Services in that period. Nothing in these Terms excludes liability that cannot be excluded by law.
12. Termination
You may close your account at any time. We may suspend or terminate the Services (in whole or in part) with immediate effect where required by law, by a Provider or card network, or where we reasonably believe there is fraud, elevated risk or a material breach of these Terms. Sections that by their nature should survive termination (including fees, chargebacks, liability and governing law) survive.
13. Changes to these terms
We may update these Terms from time to time. Material changes will be notified through the dashboard or by email with reasonable notice. Continued use of the Services after a change takes effect constitutes acceptance of the updated Terms.
14. Governing law and contact
These Terms are governed by the laws of the jurisdiction stated in your merchant agreement. Disputes are subject to the exclusive jurisdiction of the courts of that jurisdiction. Questions about these Terms: [email protected].
